Divorce in Islam
Divorce (talaq) is not encouraged in Islam. However, Muslims agree that it is permissible under specific conditions. Generally, Muslims can remarry if necessary. Marriage is a union between a man and a woman who choose to live together for life. The dissolution of the marriage bond occurs through divorce (talaq or khula), according to Islamic law.

Khula Definition
Khula is a form of talaq, a process through which a married woman can request or obtain a divorce from her husband. After a divorce, the husband is responsible for all expenses and the education of the children.

Divorce Procedure in Pakistan
The divorce (talaq) procedure can vary according to different schools of Islamic jurisprudence (Fiqas). Sunni Muslims do not require witnesses for talaq proceedings; there must be three separate declarations from the husband regarding divorce, with a waiting period of one month between each declaration. In Shia marriages, two witnesses are required to sign the Divorce Deed to formalize the divorce, and the waiting period (Iddat) must be at least three months. In Pakistan, a woman can also initiate divorce proceedings through a family court by filing a suit for khula. She must ensure that she is not pregnant before initiating the process and follow the prescribed waiting period as per legal requirements.
